Hi, the law provides that minors cannot enter into a contract, unless he or she is assisted by a guardian. If the child can secure a guardian from the court, then there is no problem for the child to receive or inherit an asset. But of course, you might want to make sure that the legal guardian is somebody you can trust.
If the child is your child, and you are a Chinese national, then perhaps it is best to inform the Chinese embassy of your blood relations so that your child will be granted a visa. But then, before you and your child can leave the country, you need to secure DSWD clearance. The said clearance will need the approval of the other spouse for the child to travel. |
