There is no criminal liability when a person fails to pay a loan, only civil liability. Meaning, there is no way to compel someone to pay until he or she has the capability. As long as you know this, then it is your decision. Just let the other party sign a promissory note!

Further, can I hold the bank deposit slip against the party who didn't return this loan?
